Terms of Service - Australia

1. Introduction

Welcome to Tapes To Digital Australia ("Company," "we," "us," or "our"). By accessing or using our services, you agree to comply with and be bound by the following terms and conditions ("Terms"). If you do not agree, you may not use our services.

2. Services Provided

We offer professional tape-to-digital conversion and video editing services. Our services include but are not limited to converting VHS, VHSC, MiniDV, Video 8, Hi8, Digital 8, Betamax, Betacam, audio cassettes, DVCAM, MPEG IMX tapes, and providing video editing and montage services.

3. Customer Responsibilities

Customers must ensure all media sent to us is legal, free of any offensive, illegal, or copyrighted content not owned by them. Customers are responsible for providing accurate information and ensuring that the materials are securely packaged for shipping.

4. Turnaround Time

Our estimated processing time varies depending on the type of service selected. We aim to complete services within the estimated timeframe; however, delays may occur due to high demand, technical issues, or unforeseen circumstances.

5. Limitation of Liability

We take great care in handling and converting your media; however, we are not liable for any loss, damage, or deterioration that may occur during the shipment or processing of your media. In the unlikely event of damage, our liability is limited to the replacement of the physical media with a similar blank medium.

6. Intellectual Property Rights

All materials and media submitted by the customer remain the property of the customer. The converted digital files and any enhanced versions produced by our services remain the customer's property. We do not claim any ownership rights over the content.

7. Price Match Guarantee

Guarantee applies only to businesses with more than two employees and those that use professional-grade equipment. Terms and conditions apply.

8. SMS Communications

8.1 Purpose of SMS messages
We may send you SMS (text) messages in connection with our services, including but not limited to:

  • Order confirmations, updates and reminders

  • Notifications about your drop-off or collection

  • Follow-up requests for feedback or reviews

  • Occasional marketing messages about offers, promotions or new services (only where you have consented to receive marketing)

8.2 Consent to receive SMS messages
By providing your mobile number to us and selecting an option indicating that you agree to receive SMS messages (for example, ticking an opt-in box on our website or forms), you consent to receiving SMS communications from Tapes To Digital for the purposes described above. You confirm that you are the owner or authorised user of the mobile number provided and that you have the authority to provide this consent.

8.3 Opting out of SMS communications
You may opt out of marketing SMS messages at any time by following the instructions in the SMS (for example, replying “STOP”) or by contacting us at contact@tapestodigital.com.au or 1300 827 370. Opting out of marketing messages will not affect SMS messages we consider necessary to perform our contract with you (for example, order updates, important service notifications or safety/security messages).

8.4 Charges and availability
We do not charge you any additional fee for sending SMS messages; however, your mobile network provider may charge you standard message and data rates. You are responsible for any such charges. Delivery of SMS messages may be affected by factors outside our control (such as your network coverage or handset). We are not liable for any delay, failure or misdirection of SMS messages.

8.5 Accuracy of mobile number
You are responsible for ensuring that the mobile number you provide to us is accurate and kept up to date. If your number changes, you must let us know as soon as reasonably possible so that we do not send messages to the wrong recipient.

8.6 Changes to SMS service
We may change, suspend or discontinue our use of SMS communications at any time. Where reasonably possible, we will notify you of any material changes to how we use SMS messages by updating these Terms or our Privacy Policy.

9. Payment and Refunds

For tape-to-digital conversion services, payment is due upon order completion and must be received before the collection or posting of the media. For video editing and montage services, payment is due upfront before the commencement of any work. Refunds will only be issued if a service cannot be completed due to technical issues or if we cannot fulfill the order for any reason. Customers must contact our customer service team within 7 days of receipt if any issues arise with their conversion.

10. Additional Fees

Long play and non-standard tapes may incur extra fees due to the additional time and resources required for conversion. 

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under these Terms shall be resolved in the courts of Australia.
